By requesting a quote, scheduling a consultation, or engaging our Services, you agree to these Terms.

1. Scope of Services

Kingston Pools provides swimming pool-related services including, but not limited to:

  • Pool design and consultation
  • New pool construction
  • Pool remodeling and renovation
  • Equipment installation and upgrades
  • Maintenance and repair services
  • Site inspection and project planning

Final scope of work will be defined in a written estimate, proposal, or contract before work begins.

2. Estimates and Pricing

All estimates are based on initial project assessments and may be adjusted due to:

  • Site conditions
  • Material price changes
  • Design modifications requested by the client
  • Unforeseen structural or environmental conditions

Any changes will be communicated and must be approved by the client before additional work is performed.

3. Payment Terms

Payment schedules will be outlined in the project agreement.

Unless otherwise stated:

  • Deposits may be required before project commencement
  • Progress payments may be required based on project milestones
  • Final payment is due upon project completion unless otherwise agreed

Failure to make timely payments may result in project delays or suspension.

4. Client Responsibilities

The client agrees to:

  • Provide accurate property and project information
  • Ensure site access for workers and equipment
  • Obtain necessary HOA approvals (if applicable) unless otherwise agreed
  • Maintain safe access to the project site

Delays caused by lack of access or approvals may affect project timelines.

5. Project Timelines

Project timelines are estimates only and may be affected by:

  • Weather conditions
  • Permit approval delays
  • Material availability
  • Unforeseen site conditions
  • Client-requested changes

Kingston Pools is not liable for delays outside its reasonable control.

6. Permits and Compliance

Unless otherwise stated in writing, the client is responsible for securing required permits and approvals.

Kingston Pools may assist in the permitting process as part of the service agreement where applicable.

7. Warranties

Any warranties related to workmanship or materials will be specified in the individual project contract.

Manufacturer warranties apply to equipment and materials where applicable.

8. Limitation of Liability

To the maximum extent permitted by law, Kingston Pools LLC is not liable for:

  • Indirect or consequential damages
  • Delays caused by weather, suppliers, or third parties
  • Property conditions not disclosed prior to work
  • Issues arising from unauthorized modifications after project completion

Kingston Pools is not liable for delays or failure to perform due to events beyond reasonable control, including:

  • Natural disasters
  • Supply chain disruptions
  • Government actions or restrictions

12. Changes to Terms

We reserve the right to update or modify these Terms at any time. Updates will be posted on this page with a revised “Last updated” date.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Texas.
